Pré requis

English language proficiency. At least one previous course in law.

Objectifs du cours

At the end of the course, the students should be able to:
Understand the main sources of labour and employment law, their institutions and key concepts in a global perspective.
Develop preventative and proactive approaches to labour law (risk management and labour law as a source of competitive advantage)
Identify the most important terms and clauses in an employment contract.
Manage dismissal situations and avoid discrimination claims.
Be familiar with methods to resolve labour-related disputes.

Contenu du cours

1. Sources of Labour Law: Fundamental Rights, International Labor Law (ILO Conventions) and national approaches (basic aspects of French and US labour laws). European Labour Law. Workers' Mobility and Transfer of Undertakings Directive.
2. Entering into an Employment Relationship. The employment contract: dos and don'ts.
3. Terminating the Employment Relationship. Dismissal and Redundancy: different types, how, under what circumstances, how much to pay?
4. Avoiding discrimination issues at work.
5. Confidentiality at Work (respecting employers and employee's privacy, GDPR basics for employers).
6. Solving labour disputes (traditional and alternative methods)
